Inadequate Safety Guards and Safety Training Lead to Cotton Gin Worker Losing His Leg
Case title: Damon Wilson v. PPF Gin & Warehouse, LLC; Lummus Corporation; Ram Manufacturing Company; and Stover Equipment Co., Inc.; Cause No. 11248 in the 62nd Judicial District Court of Delta County, Texas.
Mitch McCrea represented Damon Wilson, a recently-hired cotton gin laborer, who lost his leg when his supervisors asked him to climb onto the electronic module geared roller to remove some plastic waste and another gin employee turned on the rollers without ensuring everyone was out of harm’s way. Over the course of discovery, we learned that the cotton gin did not have adequate safety guards or controls in place to prevent the gin from restarting when someone remained in the zone of danger, nor were employees properly trained on policies and procedures.
