Negligence Causes Hay Bale to Fall and Suffocate Worker
A West Texas landowner was held liable for loaning farm equipment to a hay hauler who caused large bales of hay to fall on and suffocate a farm worker to death. Although the landowner was not present at the scene of the incident in question when it occurred, he did pay for his negligence in not having responsible safeguards in place to ensure that qualified people were operating his machinery and the loading and securing of large hay bales were done in a safe manner. The landowner settled for seven figures without going to trial.
