Trucking Collision – Control = Liability

Slack Davis Sanger recently resolved a case involving the wrongful death of a 22-year-old young man who died as a result of a head-on collision with an 18-wheeler that was traveling in the wrong lane in West Texas. The case settled for the policy limit of liability of the trucking company that owned the truck and employed the driver. SDS discovered and developed a theory of liability against a second trucking company that directed the driver to proceed to pick up a load from another location, thus establishing its “control” over the nonemployee driver. That claim also settled for the policy limit of the non-employer trucking company.
